terms and conditions

Last updated: 22 October 2026

1. Scope

These terms and conditions apply to all orders placed with Provoqué GmbH, Rebenstrasse 11, 4421 Nuglar-St. Pantaleon, Switzerland, UID CHE-342.391.825, info@provoquewatches.com, +41 79 122 27 87 ("Provoqué", "we") through provoquewatches.com. Different terms of the customer do not apply.

2. Conclusion of contract

The presentation of products in our online shop is not a binding offer. By clicking "pay now" at checkout, you submit a binding order. We send you an automatic confirmation of receipt. The contract is concluded when we accept your order by order confirmation email or by dispatching the goods. The contract language is English. We store the contract text, and you receive the order details by email.

We may decline orders, for example if a product is no longer available or in case of an obvious pricing error. In this case, any payment already made is refunded immediately.

3. Prices and payment

Prices are shown in the currency of your delivery country (CHF, EUR or USD). Provoqué GmbH is not registered for Swiss VAT, so no Swiss VAT is charged. Shipping costs are shown at checkout before you order. For deliveries outside Switzerland, import VAT, duties and carrier fees may be charged by the authorities of the destination country on delivery and are not included in the price, unless stated otherwise in our shipping policy.

Available payment methods are shown at checkout. Payment is due when you place the order.

4. Delivery

Delivery areas, costs and delivery times are set out in our shipping policy. If you are a consumer, the risk of accidental loss or damage passes to you only when the goods are delivered to you. Products are limited editions and many dials are one of a kind. If a product is no longer available after your order, we inform you immediately and refund any payment.

5. Right of withdrawal

Consumers have a statutory right of withdrawal of fourteen days. The details, the model withdrawal form and the online withdrawal function are set out in our withdrawal and returns policy.

6. Drops and early access reservation

Products are released in limited drops at announced times. An early access reservation gives access to the drop one hour before the public release and allows you to save favourite dials to your account. Saving a favourite does not reserve that product; products are sold in the order in which orders are completed. If you buy a watch during your early access hour, the reservation amount is credited as a discount on that watch. If you do not buy, the reservation amount is refunded in full on request until 11 December 2026.

7. Product information

Our dials are cut from real, used CDs. Small scratches, marks and differences in colour are part of the material and of the design and are not a defect. Colours may look different depending on your screen. The watches are water resistant as stated in the product description; water resistance is not permanent and can decrease over time.

8. Warranty for defects

The statutory warranty rights apply. For consumers, the warranty period is two years from delivery. If a product is defective, contact us at info@provoquewatches.com with your order number, a description and photos. We are your contact for all warranty claims. We will repair or replace the product, or, where the law provides for it, reduce the price or refund it. Repairs may be carried out by our manufacturing partner; we organise this for you.

The warranty does not cover normal wear and tear, damage caused by improper use, accidents, water exposure beyond the stated water resistance, or repairs or modifications not carried out by us or on our behalf. The battery is a wear part.

9. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory product liability law. In all other cases, our liability is excluded to the extent permitted by law.

10. Intellectual property

All texts, images, logos, designs and other content on our website are protected. Any use beyond what the law allows requires our prior written consent.

11. Data protection

We process personal data in accordance with our privacy policy.

12. Applicable law and jurisdiction

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence outside Switzerland, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

For merchants, the place of jurisdiction is the seat of Provoqué GmbH. Consumers may bring proceedings at their place of residence or at our seat, and can only be sued at their place of residence.

13. Final provisions

If any provision of these terms is invalid, the validity of the remaining provisions is not affected.
